The empire was formed by the conclusion of "an eternal confederation for the protection of the confederate territory," the instrument being the constitution of January 1, 1871, to which the North German Confederation, the king of Bavaria, the king of Würtemberg, the grand duke of Baden and the grand duke of Hesse und bei Rhein were parties. The empire being a confederation only, its component parts were potential sovereignties. The territorial divisions recognized by the constitution were: Prussia and Lauenburg, Bavaria, Saxony, Würtemberg, Baden, Hesse, Mecklenburg-Schwerin, Saxe-Weimar, Mecklenburg-Strelitz, Oldenburg, Brunswick, Saxe-Meiningen, Saxe-Altenburg, Saxe-Coburg-Gotha, Anhalt, Schwarzburg-Rudolstadt, SchwarzburgSondershausen, Waldeck, Reuss Older Line, Reuss Younger Line, Schaumburg-Lippe, Lippe, Lübeck, Bremen, Hamburg. The dynastic claims of the duke of Brunswick were compromised with the king of Prussia in 1913, and henceforth Brunswick was regarded as no longer a potential sovereignty.1

In the Bundesrath Prussia cast the 'former votes' of Hanover, Electoral Hesse, Holstein, Nassau, and Frankfort.

The German State (Deutsches Reich) succeeded the empire on the abdication of William II on November 9, 1918. The armistice of November 11, 1918, and the treaty of Versailles of June 28, 1919, were made with provisional governments. The constitution of the new regime is dated August 11, 1919.
