PREFACE. 89 1881 In view of the many questions affecting the Tenure of Land, whether in Ireland or in other parts of the United Kingdom, which are now under discussion, I have ventured to reprint in a connected form various essays and papers which during the last few years I have written on different branches of this subject. With one exception they are republished without addition or alteration, save that a few redundant passages have been omitted. To the article on "Common Lands," which was published in the Contemporary Review of 1879 under the title of "The Rescue of Epping Forest," I have added an historical account of the origin of Commons, and a fuller account of the movement of late years for their preservation than has yet appeared. this, as in other subjects dealt with in this volume, I have endeavoured to explain in popular language the legal principles involved, and to show how the present state of our Land Laws has been evolved even more from judicial decisions than from legislation of past times.
