Sua Magestade El-Rei de Portugal e dos Algarves, e Sua Magestade a Rainha do Reino Unido da Gran-Bretanha e Irlanda, desejando promover as amigaveis relações que existem entre os dois paizes, e regular, por meio de uma nova Convenção, a communicação postal entre os seus respectivos dominios, sobre uma base mais liberal e vantajosa, nomearam como seus Plenipotenciarios para esse fim, a saber:

His Majesty the King of Portugal and the Algarves, and Her Majesty the Queen of the United Kingdom of Great-Britain and Ireland, being desirous to promote the friendly relations existing between the two countries, and to regulate, by means of a new Convention, the communication by post between their respective domininos, upon a more liberal and advantageous basis, have named as their Plenipotentiaries for this purpose, namely:

E Sua Magestade a Rainha do Reino Unido da Gran-Bretanha e Irlanda, etc., etc., etc., ao Cavalheiro Henrique Francisco Howard, Enviado Extraordinario e Ministro Plenipotenciario de Sua Magestade Britannica junto de Sua Magestade Fidelissima;

Os quaes, depois de haverem communicado um ao outro os seus respectivos plenos poderes, que acharam estar em boa e devida fórma, concordaram nos seguintes Artigos.

CAPITULO I.

DA PERMUTAÇÃO DA CORRESPONDENCIA.

ARTIGO I.

Haverá permutação periodica e regular de correspondencias entre o Reino de Portugal e o Reino Unido da Gran-Bretanha e Irlanda, tanto para as cartas, jornaes e outros impressos originarios dos dois Estados, ou da Madeira, Açores, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, como para os artigos da mesma natureza que tiverem origem em paizes cuja correspondencia for expedida por intermedio de Portugal ou da Gran-Bretanha, ou que para elles se destinarem.

ARTIGO II.

A principal permutação da correspondencia entre Portugal e o Reino Unido terá logar por meio dos paquetes estabelecidos pelo Governo Britannico entre os dois paizes; porém fica estipulado e entendido que o Governo Britannico terá a faculdade de fazer cessar as carreiras d'esses paquetes quando julgar conveniente.

Haverá igualmente permutação de correspondencia por meio de malas fechadas, expedidas por via de França e Hespanha, assim como por navios mercantes (que adiante serão designados como «navios particulares») que navegarem entre Portugal e os portos do Reino Unido.

As malas que as Repartições dos Correios tanto Portuguez como Britannico expedirem por navios particulares, comprehenderão sómente aquella correspondencia que os remettentes desejarem que seja enviada por esse meio, e n'este caso a intenção dos mesmos remettentes será expressamente declarada nos sobrescriptos.

And Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, etc., etc., etc., Henry Francis Howard, Esquire, Her Britannic Majesty's Envoy Extraordinary and Minister Plenipotentiary at the Court of His Most Faithful Majesty;

Who, after having communicated to each. other their respective full powers, found to be in good and due form, have agreed upon the following Articles.

CHAPTER I.

EXCHANGE OF CORRESPONDENCE.

ARTICLE I.

There shall be a periodical and regular exchange of correspondence between the Kingdom of Portugal and the United Kingdom of Great Britain and Ireland, as well for letters, newspapers, and other printed papers, originating in the two States, or in Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, as for articles of the same nature originating in, or destined for, the countries the correspondence of which is forwarded through Portugal or through Great Britain.

ARTICLE II.

The principal exchange of correspondence between Portugal and the United Kingdom shall take place by means of the mail-packets maintained by the British Government between the two countries, but it is stipulated and understood that the British Government shall be at full liberty to withdraw such packets whenever it may think fit.

Correspondence shall also be exchanged by means of closed mails sent through the French and Spanish territories, as well as by means of merchant-ships (designated hereafter «private ships») plying between the ports of Portugal and the United Kingdom.

The mails which the Portuguese and British Post Offices shall exchange by private ships shall comprise only such correspondence as the senders shall expressly desire to be forwarded by these means, and in this case the intention of the said senders must be expressed in writhing on the address.

ARTIGO III.

A permutação regular da correspondencia entre as Repartições dos Correios Portuguez e Britannico será effeituada por intermedio das seguintes Estações Postacs; a saber:

Por parte de Portugal

1. Lisboa.

2. Porto.

3. Funchal (Madeira).

4. São Vicente (Cabo Verde).

Por parte da Gran-Bretanha1. Londres.

2. Southampton.

3. Liverpool.

CAPITULO II.

DOS PORTES DAS CARTAS INTERNACIONAES.

ARTIGO IV.

O porte que no Reino Unido da Gran-Bretanha e Irlanda houver de ser cobrado pelas cartas que forem lançadas no Correio do Reino Unido com direcção a Portugal, Madeira, Açòres, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, assim como pelas cartas que se receberem de Portugal, Madeira, Açôres, Ilhas de Cabo Verde, e mais possessões Portuguczas na Costa d'Africa, con direcção para o Reino Unido, será regulado do modo seguinte:

1. Cartas lançadas no Correio do Reino Unido com direcção a Portugal, Madeira, Açores, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa:

Por cada carta que não exceder o peso de duas oitavas, remettida por mar pelos paquetes Britannicos, cobrará o mesmo Correio o porte de quatro pence;

Por cada carta que não exceder o peso de duas oitavas, remettida por terra por via de França e Hespanha, cobrará o mesmo Correio o porte de seis pence;

Por cada carta que não exceder o peso de quatro oitavas, remettida directamente por navios particulares, cobrará o mesmo Correio o porte de quatro pence.

O pagamento antecipado d'estes portes será obrigatorio.

2. Cartas que se receberem de Portugal, Madeira, Açores, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, com direcção para o Reino Unido:

Por cada carta que não exceder o peso de duas oitavas, remettida por mar pelos paquetes Britannicos, cobrará o Correio Britannico o porte de oito pence;

Por cada carta que não exceder o peso de duas oitavas, remettida por terra por via de França e Hespanha, cobrará o mesino Correio o porte de seis pence;

Por cada carta que não exceder o peso de quatro oitavas, remettida directamente por navios particulares, cobrará o mesmo Correio o porte de oito pence.

The postage to be collected in the United Kingdom of Great Britain and Ireland, upon letters posted in the United Kingdom, addressed to Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, as well as upon letters received from Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, addressed to the United Kingdom, shall be as follows:

1. Upon letters posted in the United Kingdom addressed to Portugal, Madeira, the Azores, the Cap de Verd Islands, and the other Portuguese possessions on the Coast of Africa: .

For every letter not exceeding a quarter of an ounce in weight, conveyed by sea by a British mail-packet, a rate of four pence;

For every letter not exceeding a quarter of an ounce in weight, conveyed overland through France and Spain, a rate of six pence;

For every letter not exceeding half an ounce in weight, conveyed direct by private ship, a rate of four pence.

The prepayment of these rates shall be cumpulsory.

2. Upon letters received from Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, addressed to the United Kingdom:

For every letter not exceeding a quarter of an ounce in weight, conveyed by sea by a British mail-packet, a rate of eight pence;

For every letter not exceeding a quarter of an ounce in weight, conveyed overland through France and Spain, a rate of six pence;

For every letter not exceeding half an ounce in weight, conveyed direct by private ship, a rate of eight pence.

ARTIGO V. Os portes que em Portugal, Madeira, Açôres, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, houverem de ser cobrados pelas cartas recebidas do Reino Unido da Gran-Bretanha e Irlanda, com direcção para Portugal, Madeira, Açores, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, serão regulados da maneira seguinte:

Por cada carta que não exceder o peso de duas oitavas, remettida por mar pelos paquetes Britannicos, cobrará o Correio Portuguez oitenta réis;

Por cada carta que não exceder o peso de duas oitavas, remettida por terra por via de Hespanha e França, cobrará o mesmo Correio o porte de quarenta réis;

Por cada carta que não exceder o peso de quatro oitavas, remettida directamente por navios particulares, cobrará o mesmo Correio o porte de oitenta réis;

Pelas cartas originarias de Portugal, Madei-. ra, e Açores, que forem expedidas para o Reino Unido da Gran-Bretanha e Irlanda, por via de Hespanha e França, cobrará tambem a Repartição do Correio Portuguez o porte de quarenta réis por cada carta que não exceder o peso de duas oitavas.

O pagamento antecipado d'este porte será obrigatorio.

As cartas que forem expedidas para o Reino Unido por via de mar, pelos paquetes Britannicos, ou por navios particulares, não serão sujeitas a porte algum em Portugal, Madeira, Açores, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa.

Fica porém estipulado e concordado, que as cartas que houverem de ser remettidas para o Reino Unido pelos paquetes Britannicos, ou por navios particulares, e que tiverem sido lançadas no Correio em qualquer ponto do Reino de Portugal, que não seja o porto em que as malas forem embarcadas n'estes paquetes, ou navios particulares, serão sujeitas ao pagamento do porte territorial, que não excederá o actual de vinte e cinco réis por cada carta do peso de tres oitavas exclusivamente, addicionando-se vinte e cinco réis por cada duas oitavas que ac

crescerem.

ARTIGO VI.

Em relação aos portes, além do porte territorial Portuguez, que houverem de ser impostos nas cartas que excederem o peso de uma carta singela, adoptar-se-ha em ambos os paizes a seguinte escala progressiva :

1. Cartas dirigidas por terra por via de França e Hespanha, ou por mar, pelos paquetes Britannicos:

Por cada duas oitavas, ou fracção de duas oitavas, um porte igual ao das cartas singelas.

2. Cartas remettidas directamente por navios particulares:

Por cada carta que tiver peso superior a quatro oitavas, e não exceder a uma onça, dois portes de carta singela;

Por cada carta que tiver peso superior a uma

ARTICLE V.

The postage to be collected in Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, upon letters received from the United Kingdom of Great Britain and Ireland, addressed to Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa, shall be as follows:

For every letter not exceeding a quarter of an ounce in weight, conveyed by sea by a British mail-packet, eighty reis;

For every letter not exceeding a quarter of an ounce in weight, conveyed overland through Spain and France, a rate of forty reis;

For every letter not exceeding half an ounce in weight, conveyed direct by private ship, a rate of eighty reis.

Upon letters originating in Portugal, Madeira, and the Azores, and dispatched to the United Kingdom of Great Britain and Ireland, overland through Spain and France, there shall also be collected in Portugal, Madeira, and the Azores, a rate of forty reis for every letter not exceeding a quarter of an ounce in weight.

The prepayment of this rate shall be compulsory.

Upon letters dispatched to the United Kingdom by sea, by a British mail-packet or by private ship, no postage shall be collected in Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese possessions on the Coast of Africa.

It is stipulated and agreed, however, that upon all letter intended to be conveyed to the United Kingdom by British mail-packets or by private ships, posted in any part of the Kingdom of Portugal, other than the ports at which the mails are put on board such packet or private ship, and inland rate of postage, not exceeding the present rate of twenty-five reis for each letter under the weight of three-eighths of an ounce, and increasing by twenty-five reis for each additional quarter of an ounce, may be collected by the Portuguese Post Office.

ARTICLE VI.

With respect to the postage, other than the Portuguese inland rate of postage, to be collected upon letters exceeding the weight allowed for single letter, the following scale of progression shall be adopted in both countries:

1. Letters conveyed overland through France and Spain, or by sea by a British mail-packet:

For every quarter of an ounce, or fraction of a quarter of an ounce, one rate of postage. 2. Letters conveyed direct by private ship:

For every letter above the weight of half an ounce, and not exceeding one ounce, two rates of postage;

For every letter above the weight of one

onça, e não exceder a duas onças, quatro portes de carta singela;

Por cada carta que tiver peso superior a duas onças, e não exceder a tres onças, seis portes de carta singela;

E assim successivamente, augmentando-se dois portes por cada onça addicional, ou fracção de onça. ARTIGO VII.

Como excepção ás estipulações do precedente Artigo IV, fica concordado que todas as cartas lançadas no Correio do Reino Unido da GranBretanha e Irlanda, com direcção a Portugal, Madeira, e Açôres, pelas quaes tenha sido pago porte insufficiente, serão expedidas ao seu destino, com tanto que esse porte não seja inferior, pelo menos, ao de uma carta singela.

Por estas cartas o Correio Portuguez cobrará, além do porte Portuguez, a importancia da differença entre o porte previamente pago no Reino Unido e o porte devido, bem como, a titulo de multa, um porte addicional Britannico.

Esta differença de porte e multa será creditada pela Repartição do Correio Portuguez ao Correio Britannico. ARTIGO VIII.

Como excepção ás estipulações do precedente Artigo V, fica concordado que todas as cartas lançadas no Correio de Portugal, Madeira, e Açores, com direcção ao Reino Unido da GranBretanha e Irlanda, para serem remettidas por terra por via de espanha e França, pelas quaes tenha sido pago porte insufficiente, serão expedidas ao seu destino, com tanto que esse porte não seja inferior, pelo menos, ao de uma carta singela.

Por estas cartas o Correio Britannico cobrará, em addicionamento ao porte Britannico, a importancia da differença entre o porte previamente pago em Portugal, Madeira, e Açores, e o porte devido, bem como, a titulo de multa, um porte addicional Portuguez.

Esta differença de porte e multa será creditada pela Repartição do Correio Britannico ao Correio Portuguez.

ARTIGO IX.

A Repartição do Correio Britannico pagará ás de França e Hespanha o porte de transito que lhes for devido, por todas as cartas, jornaes e outros impressos expedidos entre o Reino Unido da Gran-Bretanha e Irlanda, de um lado, e Portugal, Madeira, Açôres, Ilhas de Cabo Verde, e mais possessões Portuguezas na Costa d'Africa, de outro lado, atravez do territorio Francez e Hespanhol.

No caso porém de que a Repartição do Correio Portuguez venha a concluir no futuro algum Convenio com o Correio Bespanhol, a respeito do transito de malas fechadas entre Portugal e o Reino Unido, a Repartição do Correio Portuguez terá a faculdade de tomar a seu cargo, em logar da Repartição do Correio Bri

ARTICLE VII.

In exception to the stipulations of Article IV preceding, it is agreed that all letters posted in the United Kingdom of Great Britain and Ireland, addressed to Portugal, Madeira, and the Azores, upon which an amount of postage insufficient for their prepayement has been paid, shall be forwarded to their destination, provided the postage has been prepaid to the extent, at least, of one rate.

Upon such letters there shall be collected by the Portuguese Post Office, in addition to the Portuguese postage, the amount of the difference between the postage prepaid in the United Kingdom, and the postage which should have been prepaid, together with an additional British rate as a fine.

Such deficient postage and fine shall be accouted for by the Portuguese Post Office to the British Post Office.

ARTICLE VIII.

In exception to the stipulations of Article V preceding, it is agreed that all letters posted in Portugal, Madeira, and the Azores, addressed to the United Kingdom of Great Britain and Ireland, and intended to be forwarded overland through Spain and France, upon which an amount of postage insufficient for their prepayment has been paid, shall be forwarded to their destination, provided the postage has been prepaid to the extent, at least, of one rate.

Upon such letters there shall be collected by the British Post Office, in addition to the British postage, the amount of the difference between the postage prepaid in Portugal, Madeira and the Azores, and the postage which should have been prepaid, together with an additional Portuguese rate as a fine.

Such deficient postage and fine shall be accounted for by the British Post Office to the Portuguese Post Office.

ARTICLE IX.

The British Post Office shall pay to the Post Offices of France and Spain the transit postage which will be due to those Offices, upon all letters, newspapers, and other printed papers sent between the United Kingdom of Great Britain and Ireland, on the one side, and Portugal, Madeira, the Azores, the Cape de Verd Islands, and the other Portuguese Possessions on the coast of Africa, on the other, through the French and Spanish territories.

In the event, however, of the Portuguese Post Office concluding at any future time an arrangement with the Spanish Post Office for the transit of closed mails between Portugal and the United Kingdom, the Portuguese Post Office shall be at liberty to undertake, instead of the British Post Office, the payment of the Spa
